Commentary by Attorney Michael Grossman

If it’s true that there was an intoxicated driver involved here, did authorities look into whether or not that driver was unlawfully over-served? In Texas, alcohol providers break the law when they serve someone who is obviously intoxicated. Doing so means those establishments can be responsible if their over-service leads to people getting hurt or killed.

Unfortunately, this too often goes overlooked. I’ve handled hundreds of alcohol-related accident cases. I simply can’t count how many times authorities began and ended their investigations at the crash scene. It’s entirely possible that this all was the result of one driver’s negligent. It’s also possible, though, that there’s an accomplice out there who needs to be held accountable. It’s important to ensure there are investigations thorough enough to cover both possibilities.
