Commentary by Attorney Michael Grossman
After a serious wreck, it’s natural to wonder not just how something so tragic could happen, but whether every possible factor has been thoroughly considered. When lives are lost and others left hanging in the balance, we owe it to everyone involved to look deeper than surface-level explanations.
Did the authorities thoroughly investigate the crash? Any time a vehicle suddenly veers off the road and hits a tree, the details matter a great deal. Did officers map out the crash scene in a way that could reveal the vehicle’s path before impact? Did they look into the driver’s behavior in the moments leading up to the crash, considering fatigue, distraction or a sudden medical issue? While many departments do their best with limited resources, a case like this demands more than just a standard report. A thorough reconstruction and close review of physical evidence could uncover whether something unusual happened that isn’t immediately obvious.
Has anyone looked into the possibility that a vehicle defect caused the crash? With a newer model SUV involved, it’s fair to ask whether the vehicle itself played a role. Were there any warnings or recalls related to steering, braking, or power loss? Sudden mechanical failures can cause a vehicle to veer off course with little warning, and without an inspection of the RAV4’s systems, we may never know. Even advanced vehicles aren’t immune to problems that only show up under pressure.
Has all the electronic data relating to the crash been collected? Modern vehicles hold a lot of digital clues. From braking and acceleration to steering inputs, the onboard systems may tell a more complete story. It’s also possible the vehicle’s emergency response systems or GPS logged something that could shed light on how and why the crash unfolded. That kind of information can’t wait. It needs to be pulled and preserved before it’s lost.
At the end of the day, questions like these aren’t just technical. They’re essential. Every crash deserves a full accounting of what really happened, because only then can we begin to prevent the next one.
Key Takeaways:
- Serious crashes should be backed by full scene reconstructions and a look at driver conduct.
- Mechanical inspections are critical, even in newer vehicles, to rule out defects.
- Electronic data from the vehicle can offer answers that aren’t visible at the crash scene.
