Commentary by Attorney Michael Grossman
It’s not clear yet what went wrong here, but one thing remains true across all fatal work accidents I’ve ever handled: the path forward for the victim’s loved ones is likely to be anything but simple. Here’s why.
Texas has the most complex work fatality laws of any other state in the country. Despite what many think, there is not always some automatic process for getting a family a fair resolution. Since employer’s are not required to subscribe to the workers’ comp system, it may be up to the family and the employer to sort things out themselves. It may not surprise people to learn that employers generally put their own needs first, not those of a grieving family in need of help.
That means it can take significant legal maneuvering to ensure the family gets a resolution that meets their needs. That legal maze needs to be prepared for, so if people are too quick to assume there’s an automatic path forward for them, they may quickly find themselves between a rock and a hard place.
