Commentary by Attorney Michael Grossman
Crashes involving pedestrians on highways always raise serious questions about why the person was on the roadside and whether the truck driver had an opportunity to avoid them. In this case, reports indicate that a pedestrian was standing on the shoulder when they were struck by a semi-truck. That detail is crucial because, in general, vehicles should not be traveling in the shoulder unless there’s an emergency maneuver or another factor at play.
The first question investigators need to answer is whether the truck left its lane and entered the shoulder or if the pedestrian was standing in a position where they were vulnerable to passing traffic. If the truck veered onto the shoulder, why did that happen? Was the driver distracted, drowsy or attempting to avoid another obstacle? Reviewing black box data, dashcam footage and any available witness statements could help clarify how the truck ended up striking the pedestrian.
Another issue to consider is visibility. The crash happened early in the morning, when lighting conditions may not have been ideal. Was the pedestrian easily visible to the truck driver? Were they wearing dark clothing? Was the truck using proper headlights, and was the driver paying attention? These details are critical to determining whether the truck driver should have seen and avoided the pedestrian.
At this stage, there isn’t enough public information to determine exactly what happened. But if authorities focus only on who hit whom without investigating why the pedestrian was there and how the truck ended up striking them, they may overlook key details. A full investigation should consider visibility, driver behavior and the pedestrian’s actions to ensure that all contributing factors are understood.
