Caldwell County, TX — February 8, 2025, Cyndy Hernandez Martinez was killed and one was injured in an alleged drunk driver accident at 3:38 a.m. on Highway 80.

According to initial details about the accident, it happened at the intersection of TX-80 and F.M. 110 east of San Marcos.

Investigators said that 31-year-old Cyndy Hernandez Martinez was in a Toyota Corolla going southeast on the highway. Authorities say that a Chevy Silverado in the oncoming lanes crashed with the Toyota. As a result, Hernandez Martinez was killed.

The Chevy driver had moderate injuries. Authorities allege that driver was under the influence of alcohol at the time, and they recommended a charge for intoxication manslaughter.

If these allegations are true, there’s still another crucial detail I have yet to see anything about: Was the alleged drunk driver over-served by a bar? Here’s why that matters.

In Texas, alcohol providers can be responsible if they unlawfully over-serve someone who is obviously intoxicated. Doing so can expose those establishments to potential criminal investigations, fines, and liability if the intoxication gets someone hurt or killed. Not only does this area of the law help ensure there’s accountability, it can get those negligent alcohol providers to clean up their act before more people get hurt.

Unfortunately, this possible factor too often goes overlooked. I’ve handled hundreds of cases against negligent alcohol providers. Rarely do authorities bring these wrongdoers to light. That usually requires victims and families seeking out a second opinion from someone who happens to be experienced with holding bars and other establishments accountable. Perhaps authorities here have been more thorough behind the scenes. But if they have yet to look into where this alleged drunk driver had been drinking, they’re likely not getting the whole story.
