Commentary by Attorney Michael Grossman
With a crash this serious, it’s important to understand why the investigations may be more complex than they may seem. Initially, authorities seem to have a driver at-fault. But the process authorities go to for filing charges or citations isn’t necessarily aligned with what victims and families need.
Blaming someone for a crash and actually getting a fair resolution for the victims and families are two separate matters. So if authorities put all of their focus on filing charges, they might move on before they’ve actually taken steps to analyze the crash, inspect the vehicles, pull video and cellphone data, and otherwise do a proper accident reconstruction. That results in details slipping through the cracks, which is something that’s obviously best to prevent.
As such, it’s important to make sure someone is preserving all crucial evidence surrounding a serious crash like this. That may need to be independent accident reconstructionists who can pick up where authorities left off, but so long as someone is focusing on getting the facts, that’s a prudent path forward.
