Commentary by Attorney Michael Grossman

When crashes involve heavy trucks, especially on local roads where traffic patterns can be unpredictable, it’s easy to focus on the immediate impact without looking deeper. But based on my experience, incidents like this one are rarely as simple as they seem and often involve multiple factors that need thorough investigation.

One area that stands out here is the operation of the dump truck itself. These vehicles, by nature, require careful handling due to their size, weight, and often limited maneuverability. Exploring whether the dump truck was safely operated within the speed limits for the area, as well as the truck’s condition, could be pivotal in determining the full picture of the crash. Mechanical failures or improper handling can make a vehicle as large as a dump truck even more dangerous to the smaller vehicles around it.

Additionally, we can’t overlook the responsibility of the commercial company, if the truck was operating under one. Companies are responsible for maintaining their vehicles and ensuring that their drivers are properly trained and fit to be behind the wheel. A lapse in any of these areas—such as delayed maintenance, insufficient driver preparation, or pressure to complete a route hastily—could point to shared responsibility for the crash beyond the driver alone.

Ultimately, the goal of a thorough investigation is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
