How Did This Accident Occur?
When it comes to car accidents, people generally just assume everything comes down to either speeding or a driver being on their phone. Those are common factors, but a proper investigation should simply let the evidence speak for itself. Otherwise, something important could slip through the cracks.
For instance, I recall a crash from a while back out of west Texas. To be clear, it wasn’t a case I handled but rather one I learned about through some friends of the firm. Authorities initially said a man ran a stop sign, resulting in a serious truck accident. That’s all the public knew for well over a month. Well, I found out from an accident reconstructionist who worked in the area that TxDOT had actually removed the stop sign from that crossing. They forgot to replace it when they left for the day, meaning the victim likely thought they had the right-of-way when the crash occurred.
That’s obviously an unusual situation, and I’m not saying that happened here, necessarily. However, there’s something that I learned a long time ago in my career. The thing about one-in-a-million situations is that there are about a million different one-in-a-million situations. Just because something is unlikely doesn’t mean it won’t happen. So something like missing signage, for example, deserves as much attention as distracted driving. Hopefully investigators handling this crash understand that and act accordingly.
