Houston, TX — December 14, 2023, Charles Brayford was killed as the result of a car versus pedestrian accident at 9:30 p.m. on North Shepherd Drive.

Authorities said in their initial statements that the collision occurred near the Shepherd collision with Leago Road.

Harris County officials identified 58-year-old Charles Brayford as a pedestrian who was reportedly walking on northbound lanes of Shepherd Drive. While in the roadway, it appears a northbound driver hit Brayford, resulting in fatal injuries. That driver was allegedly under the influence of drugs at the time and recommended to face a charge for DWI.

Without knowing more here, there’s a pretty serious unanswered question: Was the driver’s alleged intoxication the reason this fatal accident happened?

Put simply, a significant factor in pedestrian accidents is whether or not the driver could have reasonably avoided hitting the victim. If someone isn’t clearly visible or enters the path of a driver suddenly, even a sober, attentive driver may not be able to avoid them. But if a safe driver could see and avoid that person, a driver failing to do so would likely mean they’re partially if not primarily responsible for the collision.

With that in mind, have investigators done in an accident reconstruction to determine if the supposed drugs involved here prevented the driver from avoiding an otherwise avoidable collision? I’d hate to think they overlooked something like that, but it sadly wouldn’t be the first time an official crash investigation missed something important.
