Commentary by Attorney Michael Grossman
My concern with single-vehicle wrecks is whether or not they’re handled properly by investigators. They’re not often seen as a high priority, so authorities sometimes move on without actually looking into every possible factor. That’s when important details slip through the cracks.
For example, I had a case where authorities, after a cursory glimpse at a crash scene, ended up blaming a driver for not wearing their seatbelt. The family, though, knew the victim always wore their seatbelt. They wanted to know what was going on, so we had independent investigations look into things. As it turned out, the victim’s seatbelt was defective. The victim was wearing it properly, but it failed during the crash, causing them to be thrown from the seat. Authorities just jumped to conclusions because they didn’t take the time to actually investigate the evidence.
I’m not saying anything like that happened here, but that’s why a lot of families find themselves still looking for answers even after authorities “finish” their investigations. Sometimes, authorities really are thorough, and independent investigations help to confirm that people are getting the answers they deserve. More often, though, an independent investigation can reveal something that otherwise would have slipped through the cracks.
