Commentary by Attorney Michael Grossman
When I see reports of a single-vehicle rollover crash like the one that occurred on East Frontage Road, my first thought is that these types of incidents often don’t get the scrutiny they deserve. It’s easy to assume that when a vehicle rolls over without another car involved, the driver must have made a mistake. But that assumption can prevent the real story from coming to light. In order to fully understand what caused this crash, there are three critical questions that must be asked.
First, did the authorities thoroughly investigate the crash? A rollover accident demands more than a cursory review. Investigators need to analyze tire marks, roadway conditions, vehicle damage, and whether there were any contributing environmental factors—such as uneven pavement or debris on the road. Did the investigating officers perform a full reconstruction? Did they consider the possibility that something other than driver behavior contributed to the loss of control? Depending on the department and the resources available, the answers to those questions aren’t always guaranteed.
Second, has anyone looked into the possibility that a vehicle defect caused the crash? Pickup trucks, due to their design and higher center of gravity, are more prone to rollover accidents—especially if there’s a suspension issue or a problem with the tires or brakes. Even a seemingly minor defect, like a malfunctioning steering component or unexpected brake pull, could cause a driver to lose control. If no one examines the vehicle thoroughly, those clues can be missed. And if the vehicle is released or repaired before an independent inspection takes place, the opportunity to identify a defect may be lost forever.
Third, has all the electronic data relating to the crash been collected? Vehicles involved in rollovers often contain engine control modules (ECMs) that log valuable pre-crash data such as speed, brake usage, and steering input. This kind of information is critical to understanding what was happening in the moments before the vehicle overturned. Additionally, surveillance footage from nearby businesses or cell phone data could provide context about the driver’s actions or road conditions. But like all digital evidence, this data is time-sensitive and must be preserved quickly to avoid permanent loss.
Even though early reports say the driver was the only one involved, that doesn’t mean the cause of the crash is obvious. Rollover accidents can result from a number of factors, and unless those possibilities are actively explored, the real cause may never come to light. That’s why it’s so important to ask the right questions and ensure that every angle is thoroughly investigated. The person injured in this crash—and their family—deserve answers based on facts, not assumptions.
