Commentary by Attorney Michael Grossman

When a driver drifts across the centerline and causes a chain-reaction crash, it’s easy to stop at the explanation of “he fell asleep.” But even when a cause seems obvious, that doesn’t mean the investigation is over—or that other contributing factors should be ignored.

1. Did the authorities thoroughly investigate the crash?
With three vehicles involved, including a head-on collision and debris impacting a third car, the scene should have been fully reconstructed. Investigators need to account for vehicle speeds, braking attempts, and impact angles to understand how and when things unfolded. Simply noting that the driver fell asleep isn’t enough. It’s also important to ask if there were signs of fatigue earlier in the drive and whether the vehicle showed any pre-crash behavior that should have raised concern. The quality of that work depends on the resources and experience of the responding team.

2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Even when fatigue is cited, it’s worth confirming that the Dodge Charger didn’t suffer from any mechanical issue that made the situation worse—like a steering or lane-assist failure that failed to correct the drift. Similarly, the Ford Escape’s tire detaching raises its own set of questions. Did the collision cause it to break free, or was there a preexisting issue with the wheel assembly or suspension? Unless all vehicles are inspected closely, critical factors could be missed.

3. Has all the electronic data relating to the crash been collected?
All three vehicles likely contain electronic data that could shed light on what happened. The Charger’s systems may show steering activity, speed, and whether the driver made any last-second corrections. The Escape and Rogue may offer information about braking or stability responses. GPS data and any in-car cameras or mobile devices could provide added context. If that data wasn’t collected promptly, it may already be gone—and with it, the clearest picture of what really happened.

Even when the explanation appears straightforward, real answers come from looking at the full picture—not just what’s most obvious at first glance.

Takeaways:

  • Multi-vehicle crashes require detailed scene reconstruction and review of driver behavior.
  • The source of mechanical issues—like a detached tire—must be inspected, not assumed.
  • Electronic data from all involved vehicles can confirm or challenge initial crash explanations.
