Commentary by Attorney Michael Grossman
Crashes involving a single vehicle often raise more questions than answers, especially when the vehicle leaves the roadway and overturns. Without another vehicle in the picture, it’s easy to assume the cause lies with the driver—but that assumption can miss critical pieces of the puzzle.
Was the crash investigated with enough detail to reveal what really happened?
When a Jeep overturns and hits a tree, the mechanics of how it got there matter. Did investigators take measurements to determine whether the vehicle swerved suddenly or gradually veered off? Was the surface of the roadway analyzed for clues about the vehicle’s path? Not all crash scenes get that level of attention, and when they don’t, the actual cause may never be uncovered.
Could a mechanical failure be responsible for the loss of control?
The Jeep Patriot, like any vehicle, can experience failures in steering, brakes, or suspension—all of which could cause a sudden loss of control. If no mechanical inspection was done, especially after a rollover, there’s a risk that an underlying defect or failure is being overlooked. That’s a critical oversight in any crash where the driver may not have had a chance to respond.
Was any electronic data collected to verify the sequence of events?
Modern vehicles often store valuable data that can confirm speed, braking, and steering actions just before a crash. If that information from the Jeep was retrieved, it could help explain whether the driver attempted to regain control or if the vehicle didn’t respond to input. Additionally, phone or GPS data could provide extra context. Without that evidence, any conclusion remains incomplete.
Unexplained crashes don’t just need an explanation—they need a complete one. And that only happens when the questions go deeper than what the scene alone can show.
Takeaways:
- Detailed crash reconstruction is essential in single-vehicle rollovers.
- Mechanical issues like brake or steering failure should always be ruled out.
- Electronic vehicle and device data may clarify the driver’s actions and vehicle response.
