Commentary by Attorney Michael Grossman
Alcohol can make things very complex for the people hurt as it can bring up areas of the law authorities don’t always address. Specifically, alcohol providers can be responsible a crash like this if they unlawfully over-served the intoxicated driver. This can result in criminal investigations, fines, suspended licenses, or liability for the injuries the intoxicated driver causes to themselves or others.
Too often, though, authorities are more focused on finding someone to blame than they are getting answers for those involved in the crash. Obviously, there should be appropriate consequences for something as serious as intoxicated driving, but that should include any accomplices who would otherwise be let off the hook while those they harmed are left bearing the burden alone. Texas law helps provide avenues to ensure that doesn’t happen.
