Commentary by Attorney Michael Grossman

Authorities said that alcohol may have been a factor in the accident, and that could present some unique hurdles that people aren’t often aware of. In short, Texas has laws that make alcohol providers liable if they over-serve an intoxicated person who then causes an accident. So while authorities may put all of their focus on an alleged intoxicated driver, there may need to be independent investigations to see any complicit alcohol providers held accountable for their actions. Maybe authorities here have been more on the ball in that regard, but frankly I can recall few cases where we began investigations into a negligent alcohol provider and found authorities already ahead of us. It’d be unusual to see otherwise here.
