Commentary by Attorney Michael Grossman
One-car accidents can seem simple at first glance, but a thorough investigation is warranted whenever someone dies in a vehicle crash. In my opinion, such investigations must answer three basic questions.
1. Did the authorities thoroughly investigate the crash?
Initial details suggest the investigation is ongoing, but these critical aspects need to be explored:
- Crash site conditions: Investigators should evaluate whether the median was properly marked and whether lighting, signage or road design could have contributed to the crash.
- Witnesses or surveillance: Identifying any potential witnesses or reviewing surveillance footage from nearby businesses or homes may help clarify how the crash unfolded.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Mechanical or systemic failures in the Honda Accord should not be overlooked as potential contributors to the crash:
- Steering or suspension issues: These could cause the driver to lose control, particularly if the vehicle struck the median unexpectedly.
- Brake system failure: If the brakes malfunctioned, the driver may have been unable to stop before hitting the median or tree.
- Crashworthiness: Post-impact, the performance of the car’s safety systems—such as airbags and seatbelts—should be evaluated to determine whether they functioned as intended to protect the driver.
A detailed mechanical inspection of the vehicle is crucial to rule out any potential defects or malfunctions.
3. Has all the electronic data relating to the crash been collected?
Data stored in the Honda Accord’s systems can provide critical insight into the moments leading up to the crash. Key data to retrieve includes:
- Engine Control Module (ECM): The ECM may contain details about the vehicle’s speed, steering, braking and throttle inputs leading up to the impact.
- Maintenance records: Reviewing the vehicle’s service history could identify whether any known issues with the vehicle were left unaddressed.
Collecting this data promptly is essential to preserve it for analysis.
Answering these questions should help this man’s family understand what happened in his final moments. If authorities can’t answer them to the family’s satisfaction, perhaps an outside expert could help bring them some closure.
