Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that I hope investigators are able to provide clear answers for the person involved and their loved ones. A single-vehicle crash may seem straightforward, but in my experience, these incidents are often more complex than they first appear. To truly understand what happened, three critical questions must be asked.

First, have authorities thoroughly investigated the crash? Law enforcement will typically document the scene, assess road conditions, and look for any external factors that may have contributed to the loss of control. However, deeper analysis is often necessary. Were there hazards on Route C, such as debris, potholes, or black ice, that could have affected the vehicle’s stability? Were there any tire marks indicating an attempt to brake or avoid something in the road? A full accident reconstruction could help determine whether external conditions played a role.

Second, has anyone looked into the possibility of a vehicle defect? People often assume that a driver losing control is due to human error, but mechanical failures—such as brake malfunctions, power steering issues, or tire blowouts—can also be contributing factors. Unfortunately, vehicle defects are often overlooked in crash investigations unless a forensic examination is performed. If the Mercury Milan is quickly scrapped or repaired, crucial evidence may be lost before investigators have a chance to determine whether a defect played a role.

Third, has all electronic data relating to the crash been collected? Many modern vehicles store valuable information in their electronic control module (ECM), which may reveal whether the driver attempted to brake, how fast the vehicle was traveling, and if any mechanical issues were detected before the crash. Additionally, if there were nearby surveillance cameras or traffic footage, they might provide further insights into what happened. If investigators don’t secure this evidence quickly, it could be lost, making it harder to determine exactly what led to the crash.

At the end of the day, the person involved and their family deserve clear answers. If the official investigation leaves any unanswered questions, independent experts may be needed to ensure that every possible factor is considered. Whether the cause was environmental, mechanical, or something else entirely, the community owes it to those affected to make sure that all available evidence is carefully examined.
