Commentary by Attorney Michael Grossman
When a vehicle unexpectedly crosses into oncoming traffic, the result can be devastating—but understanding how and why that happened takes more than just observing the aftermath. Especially when lives are lost, surface-level explanations fall short of what’s truly needed.
1. Did the authorities thoroughly investigate the crash?
A full crash reconstruction should be the standard in a head-on collision with multiple injuries and one confirmed fatality. That involves charting vehicle paths, determining speeds, and analyzing the point of impact. Investigators should be asking what caused the Mazda to swerve—was it a steering error, a delayed response, or something else entirely? These questions only get answered if the scene is mapped in detail and witness accounts are cross-checked with physical evidence.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
When a car suddenly veers into the wrong lane, a mechanical failure has to be considered. That could include a steering malfunction, a stuck accelerator, or issues with the braking system. Even something as subtle as a suspension fault could cause a sudden pull to one side. If no one closely inspects the Mazda for such defects, those possibilities could be missed entirely—leaving a major factor unexplored.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles, including the Mazda and SUV involved, are likely equipped with event data recorders that can shed light on the driver’s actions leading up to the crash. Speed, steering input, and brake usage are all recorded in the moments before a collision. That data, combined with phone records or traffic camera footage, could clarify whether the swerve was abrupt or gradual, intentional or reactive. Without this information, the timeline of events remains incomplete.
When vehicles cross into opposing lanes without explanation, the most important facts aren’t always visible. It takes time, effort, and the right tools to make sure the full story comes to light.
Takeaways:
- Head-on collisions require full reconstructions to understand lane departures.
- Vehicle inspections should rule out mechanical failures in steering or braking.
- Event recorders and camera footage can reveal how and when a vehicle lost control.
