Commentary by Attorney Michael Grossman
When someone loses their life in a single-vehicle rollover crash, especially early in the morning when traffic is light and road conditions may vary, it’s tempting to chalk it up to driver error. But in my experience, crashes like this one on U.S. Highway 181 rarely stem from just one factor. To truly understand what caused the vehicle to leave its lane and overturn, there are three important questions that should be asked.
First, did the authorities conduct a thorough investigation? A crash at 6:45 a.m. could involve limited visibility, changing light conditions, or environmental factors like dew or road debris. Investigators should examine whether the road was properly marked, whether the shoulder or slope contributed to the rollover, and if any roadway hazards played a role. The path of the vehicle, the number and depth of tire marks, and damage patterns can all provide clues. If these details weren’t fully documented, an independent reconstruction may be necessary to uncover the full sequence of events.
Second, has anyone considered whether a mechanical failure or defect contributed to the crash? A sudden loss of lane control could point to an issue with the Charger’s steering, suspension, brakes, or tires—especially if the rollover followed a sharp or unexpected maneuver. These are the kinds of problems that don’t typically show up in a standard crash report and require a forensic inspection of the vehicle to confirm. That kind of investigation is only possible if the vehicle is preserved and made available for detailed analysis.
Lastly, has all of the electronic data from the vehicle been collected? The Dodge Charger is likely equipped with an event data recorder that stores key information like vehicle speed, steering input, throttle position, and brake usage in the moments leading up to the crash. This data can help determine whether the driver made an attempt to regain control or whether the vehicle failed to respond. Additional data, such as GPS logs or footage from nearby businesses or traffic cameras, may also help clarify what happened. As with all electronic evidence, time is of the essence in securing this information.
In any fatal crash where the cause remains uncertain, it’s not enough to settle for initial impressions. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
