Commentary by Attorney Michael Grossman
It’s unfortunately not surprising to see this accident result in charges for intoxication manslaughter. The reality is intoxicated driving is by far the most common reason drivers get on the wrong side of the road. Even if the allegations are true, though, the investigations can’t just stop at the alleged drunk driver. A thorough investigation would also have to find out where that alcohol came from and if a negligent alcohol provider also contributed to the accident.
Let me explain why I bring this up. Not that long ago, a family called us after a drunk driver turned into oncoming lanes and hit their vehicle head-on, nearly killing their young son. While authorities went to great lengths to see the drunk driver held accountable, their investigations began and ended there. Meanwhile, our investigations retraced the man’s steps, and we found out he’d been reckless and illegally over-served by a local bar.
Evidence from the bar—including witness testimony, security footage, and credit card receipts—showed the man had far too much to drink. He could barely walk to the bathroom without falling over. Still, servers kept pouring drinks, eventually sending the man out onto the road to cause a devastating accident. Under Texas law, that meant the bar was legally responsible for contributing to the accident, as well.
Had things been left solely to the police, though, that bar likely would have flown under the radar to continue business as usual, and more people would likely get hurt. Because that family was motivated to have as many experienced eyes as possible looking things over, our investigations brought that establishment to light and made sure they were held accountable for their role in the accident just as the drunk driver was held accountable for his.
That’s why it’s crucial to investigate the possibility of negligent alcohol providers after any wrong-way accident. In my experience with hundreds of alcohol-related accident cases, families don’t just want a bad guy to blame. They want accountability. Sometimes, that’s just a single reckless driver. Other times, there’s an accomplice that requires more thorough investigations than a typical crash reconstruction. Either way, a family shouldn’t have to wonder whether or not they’re getting the whole story. Moreover, they deserve to know their rights under Texas law and the potential avenues available to them that can help ensure those who wronged them face justice.
