Commentary by Attorney Michael Grossman
When I see reports of a crash like this, my main concern is whether Benjamin Dominguez and his loved ones will get the answers they need about what happened. A single-vehicle crash involving a parked car may seem straightforward, but experience has shown me that these cases often involve more factors than they first appear to. That’s why it’s essential to examine three key questions when looking into any serious crash.
The first question is whether authorities have conducted a thorough investigation. Law enforcement will likely assess the scene, document vehicle positions, and attempt to determine why the Malibu failed to complete its passing maneuver safely. However, certain critical details can sometimes go overlooked. Was there an oncoming vehicle or another external factor that forced the Malibu into the parked car? Were there any roadway hazards, such as poor lighting or debris? Did officers have enough time and resources to fully reconstruct the crash? Ensuring these questions are answered is essential to getting a full understanding of what happened.
The second question to consider is whether anyone has looked into the possibility of a vehicle defect. If the Chevrolet Malibu experienced a steering failure, brake malfunction, or a tire issue that caused the vehicle to lose control, that could be a crucial factor in understanding the crash. Unfortunately, mechanical failures are rarely investigated unless someone specifically requests that possibility be explored. A forensic examination of the vehicle could help determine whether a defect played a role in the accident.
Finally, it’s important to determine whether all relevant electronic data has been collected. The Malibu’s engine control module may have recorded key details about speed, braking, and steering inputs before the crash. Additionally, surveillance footage from nearby businesses or dashcam footage from other drivers could provide visual evidence of what happened. Even cellphone data might be relevant if distraction played a role. The sooner this information is secured, the better it can help clarify the circumstances surrounding the accident.
At the end of the day, answering these questions could be essential to understanding what really happened and why. A thorough examination of all three of these issues—including the quality of police investigations, possible vehicle defects, and electronic data—is the least that can be done to ensure that those affected by the crash receive the clarity they deserve.
