Commentary by Attorney Michael Grossman

Single-vehicle wrecks can present unique challenges, and that sometimes catches folks by surprise. They figure things should be simple, so authorities will just handle the whole thing. In reality, authorities sometimes get caught up only considering common possible factors, and they might be more concerned with blaming someone than actually gathering the facts. That’s why it helps to consider what kind of effort authorities are making in their investigations.

Do they have experienced officers looking into things? Do officers have access to proper equipment? Are they being given the time they need to investigate complex possible factors? Have they consider possible defects, such as brake failure, faulty tires, steering issues, or lane assistance malfunctions? Did the victim’s airbags go off? Did their seatbelts work properly? Is there any video footage from nearby traffic cameras, businesses, or residences?

Simply put, I’ve seen countless examples of these kinds of factors slipping through the cracks. When authorities treat an accident like it’s no big deal, they risk overlooking important information or coming to conclusions there isn’t enough evidence to support. That’s why victims and families looking to tell their side of the story generally fare better when relying on independent accident reconstructions, rather than just waiting for authorities. Maybe authorities here have been more thorough, but that’s not something I’d take for granted.
