Commentary by Attorney Michael Grossman

Looking at this intersection, it would appear traffic on 4th Street has a stop sign while Monte Carlo does not. So does that the Jeep should have yielded to the motorcycle? Why wouldn’t authorities be blaming that driver for failure to yield? Well, it could be there were extenuating circumstances that made the Jeep driver reasonably think the coast was clear. Or, it could be authorities just haven’t completed their investigations.

Most concerning, though, is that authorities often think the worst of motorcyclists, and they may assume the rider did something wrong no matter what. That’s why accidents like this are often better off in the hands of independent accident reconstructionists who know to put bias aside and let the evidence speak for itself. Whatever happened here, the victim’s loved ones at least deserve to know they’re getting the truth. Is there something authorities are overlooking here?
