Commentary by Attorney Michael Grossman
Crashes like this one, involving a semi-truck reportedly failing to yield the right-of-way at an intersection, often raise significant questions about driver judgment and adherence to traffic laws. From my experience, incidents like these frequently highlight not only driver actions but also the broader responsibilities of the trucking companies that employ them.
A key issue in this case is why the Mack truck entered the intersection at an unsafe time. Commercial drivers are held to a higher standard of care due to the size and weight of their vehicles, and failing to yield the right-of-way at a stop sign suggests potential inattention, distraction, or impatience. Investigators should examine whether the truck driver was alert and complying with safety protocols or if external factors, such as fatigue or impairment, may have played a role. The truck’s onboard systems, such as dashcams or event data recorders, could provide crucial evidence about the driver’s actions leading up to the crash.
The trucking company’s role also warrants close examination. Companies are responsible for training their drivers to operate safely, especially in complex traffic situations like intersections. If the driver was inadequately trained, or if scheduling pressures encouraged rushed or unsafe driving, the company may share responsibility for what occurred. Additionally, reviewing the company’s safety protocols, hiring practices, and compliance with federal regulations can help determine whether the company prioritized safety or cut corners in its operations.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
