Potter County, TX — September 9, 2024, Arthur Foster and two others were injured in a car accident at approximately 3:45 p.m. along Finch Highway.
According to authorities, 81-year-old Arthur Foster and a 79-year-old woman were traveling in a northbound Toyota Prius on S.H. 136 in the vicinity southwest of Wilhelm when the accident took place.

Officials indicate that, for reasons yet to be confirmed, a northbound Lexus occupied by a 79-year-old woman failed to appropriately control its speed. A collision consequently took place between the rear-end of the Prius and the front-end of the Lexus. The impact apparently pushed the Prius into the right lane of the highway where it was involved in a secondary collision with the back-left quarter of a Dodge Charger.
Foster reportedly suffered serious injuries due to the wreck. The woman who was with him in the Prius and the woman from the Lexus each sustained moderate injuries, as well, according to reports. Additional details pertaining to this incident are not available at this point in time.
Commentary by Attorney Michael Grossman
When serious accidents like the one involving Arthur Foster happen, it’s critical that a full and thorough investigation takes place. With over three decades of experience handling serious injury and fatal accident cases, I’ve seen how important it is not to take early assumptions at face value. A careful, methodical approach often reveals causes and factors that are not immediately obvious.
One of the first questions that should be asked is whether authorities conducted a thorough investigation. In a crash involving multiple impacts like this one, documenting each collision sequence, gathering measurements at the scene, and interviewing all available witnesses are essential steps. Investigators should also look into road conditions, the timing of events, and any nearby surveillance footage that could help piece together exactly how the wreck unfolded.
Another critical issue is whether a vehicle defect may have played a role. In situations where a driver allegedly fails to control their speed, it’s important to verify whether that was due to operator error, mechanical failure, or a combination of factors. Brake malfunctions, stuck accelerators, or tire issues could all contribute to a loss of control, but without inspecting the vehicles, there’s no way to know for sure.
It’s equally important to ensure that all available electronic data from the vehicles has been secured. Most modern cars and trucks have event data recorders (EDRs) that can reveal critical information such as speed, brake usage, and throttle position in the moments leading up to the crash. Without that data, critical insights could be lost forever, leaving unanswered questions about how and why the wreck happened.
Answering these three questions is critical to making sure that no stone is left unturned in understanding the causes of a crash like this. Serious wrecks deserve serious investigation, not assumptions. Getting clear answers to these questions is crucial for those seeking to understand what happened and why—and it’s the least that can be done to help those affected find the clarity and closure they deserve.
