Commentary by Attorney Michael Grossman
If the allegations here are true, authorities have yet to specify if they believe drugs or alcohol led to the accident. This is actually a very important distinction, as there may need to be investigations into an accomplice who also could be responsible for contributing to the deadly accident. Simply put, alcohol-related crashes often involve drivers who were unlawfully over-served by a bar or similar establishment. This can expose those alcohol providers to potential criminal investigations, fines, suspensions of their liquor license, or liability for the result deaths or injuries.
What makes me concerned in that regard is how often authorities overlook negligent alcohol providers, allowing them to continue putting the community in danger. I’ve had hundreds of cases against negligent alcohol providers who contributed to an alcohol-related accident. I can’t count how many times victims and families came to us, had no idea there might be a bar or liquor store involved in their accident, and only got to see accountability because they happened to seek out help independent of the authorities. I’ve even had cases where we shared with authorities the evidence we found of an alcohol provider’s unlawful actions, and they still made no effort to pursue their own investigations.
It could be that authorities here are being thorough behind the scenes so the victim’s loved ones get the answers and the resolution they deserve. It could be that there’s only one reckless individual who needs to answer for what happened here. In my experience, though, the details in the news following a serious accident rarely tell the whole story, even when there’s someone facing charges. Ultimately, accountability means ensuring all wrongdoers face appropriate consequences for their actions. It remains to be seen if that’s happening here.
