Frankly, it would be more surprising if intoxicated driving wasn’t a suspected factor here. It’s almost always the reason someone gets on the wrong side of the road, as they’re completely unaware of their surroundings. What makes this particularly crucial to consider, though, is the possibility some local alcohol provider unlawfully helped someone get so drunk they couldn’t tell one way from another. If that happened here, the alcohol provider may also be responsible for contributing to the fatal crash.
In Texas, it’s unlawful for bars and other similar establishments to serve someone who is obviously intoxicated. If they do so, it exposes them to potential criminal investigations, fines, suspended licenses, or liability for the resulting injuries or deaths.
Too often, though, these alcohol providers fly under the radar. I’ve handled hundreds of cases against negligent alcohol providers. Usually, they’re only brought to light after a victim’s loved ones seek out independent investigations. That’s why it’s important for people to always follow up on their instincts if they feel they’re not getting the whole story. Not only could there be more to the story, there could be an accomplice who has yet to be held accountable for their actions.
