Commentary by Attorney Michael Grossman

When a crash involves a commercial truck drifting onto the shoulder and striking a pedestrian, it raises immediate and serious questions about the driver’s attentiveness and the company’s role in ensuring safety on the road. This is especially true in cases like this, where a man died doing what most would consider prudent: standing by his disabled vehicle on the shoulder.

The first question that comes to mind is why did the truck drift across the solid white line? Solid white lines mark the boundary between lanes of travel and the shoulder, and crossing them without cause suggests a failure to maintain proper lane discipline. Whether this was due to distraction, fatigue, a medical emergency or even inadequate driver training must be thoroughly investigated.

Commercial truck drivers are held to a higher standard of care because of the size and weight of their vehicles. A lapse in attention or judgment in a passenger car might cause property damage, but in a semi-truck, the results can be deadly. Determining the truck driver’s state at the time of the crash — such as whether they were using a cell phone, adjusting vehicle controls, or dealing with fatigue — is critical. Subpoenaing cell phone records and reviewing engine control module (ECM) data can shed light on these factors.

It’s also crucial to assess whether the trucking company contributed to the crash through negligent practices. Did the company enforce policies that may have led to driver fatigue? Was the driver adequately trained and monitored? Were there mechanical issues with the truck that caused or contributed to the crash? These questions often reveal systemic issues that go beyond the immediate actions of the driver.

The fact that authorities have ruled out alcohol and excessive speed as factors is important, but it doesn’t resolve the matter. Many crashes like this result from preventable distractions or a lack of vigilance, not just gross negligence or reckless driving. The victims’ loved ones deserve answers, and they’re unlikely to find them without an investigation that goes beyond the initial police report.

Ultimately, this case highlights the unique dangers posed by commercial vehicles and the grave consequences of any failure — by the driver or the company — to uphold safety standards. For Amin Hammoud’s family, understanding the full scope of accountability is not just about justice for their loss but about preventing similar tragedies in the future.
