Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope investigators are doing everything necessary to provide the driver’s family with a clear, fact-based explanation of how this incident occurred. A vehicle veering off the roadway and colliding with a traffic light pole raises serious questions, particularly when the outcome is fatal. To fully understand what happened at the intersection of Bell Street and SW 45th Avenue, we need to ask three critical questions.
First, did the authorities thoroughly investigate the crash? At 3 a.m., road visibility and lighting conditions are essential factors. Was the area well-lit, and were road markings and signage clearly visible? Were there environmental conditions — such as wet pavement or obstacles in the roadway — that could have played a role in the vehicle leaving its lane? Investigators should also examine whether the geometry of the intersection or a potential evasive maneuver contributed to the loss of control. A complete scene analysis, including skid marks, vehicle rest position and evidence of braking or swerving, is key to understanding how the vehicle ended up off the road.
Second, has anyone looked into the possibility that a vehicle defect contributed to the crash or the severity of the injury? The 2022 Volkswagen Taos is a relatively new vehicle, but even newer models can experience critical mechanical or electronic failures. Investigators should evaluate whether the vehicle’s steering, braking or stability control systems were functioning properly at the time. Tire condition, which can affect traction and control, should also be examined. Furthermore, in a crash where the vehicle strikes a fixed object, it’s important to confirm that safety systems such as seatbelts and airbags deployed correctly and that the vehicle’s structure absorbed the impact as intended.
Finally, has all the electronic data related to the crash been collected? The Volkswagen Taos is equipped with an event data recorder that can capture key pre-crash information, such as speed, throttle position, brake use and steering input. This data can help determine whether the driver attempted to correct course or respond to an unexpected situation. If nearby traffic or security cameras captured the incident, or if GPS or mobile device data is available, these sources can also help build a clearer picture of the events leading up to the crash. Early preservation of this data is crucial.
Crashes like this may initially appear to be isolated incidents, but they often involve a combination of factors — mechanical, environmental or design-related —t hat warrant a closer look. A woman lost her life, and those closest to her deserve a full accounting of what happened and why. That clarity is only possible when the right questions are asked and the right evidence is secured and analyzed.
