Commentary by Attorney Michael Grossman

When a vehicle ends up off course and someone is seriously hurt, the explanation often starts and ends with driver error. But that kind of quick conclusion leaves too much out. Especially in single-car crashes, the real cause may lie in details that only a deeper investigation can reveal.

1. Did the authorities thoroughly investigate the crash?
A nighttime crash involving a curb strike should lead to a full examination of the vehicle’s path. Did investigators look at steering input, tire marks, or braking patterns before impact? Was it clear whether the driver tried to correct or if the vehicle suddenly veered without warning? Without careful scene documentation, those answers may never surface—and that leaves too much room for guesswork.

2. Has anyone looked into the possibility that a vehicle defect caused the crash?
A BMW leaving its lane for no clear reason raises the question of mechanical failure. Issues like steering loss, brake malfunction, or electronic system errors can cause a sudden departure from the road—especially in modern vehicles with complex control systems. These problems often don’t show visible signs. Unless the vehicle was inspected thoroughly and promptly, a hidden defect could be missed entirely.

3. Has all the electronic data relating to the crash been collected?
The BMW almost certainly contains onboard data that can reveal critical moments before the crash—steering angle, speed, throttle use, and brake application. If there was no driver input, or if the systems didn’t respond, that data could make the difference in understanding what happened. Phone records and GPS logs might also help clarify what the driver was doing in the moments before the incident. But without early action, that information could be lost or overwritten.

When someone is seriously injured in a crash like this, it’s not enough to say they “lost control.” Getting the full picture means asking the questions that reach beyond the surface.

Takeaways:

  • Nighttime single-car crashes demand full scene analysis to understand vehicle behavior.
  • Mechanical or system failures can cause sudden lane departure and may go undetected.
  • Vehicle and phone data can reveal key context—but must be pulled quickly.
