Commentary by Attorney Michael Grossman
When people see that alcohol may be involved in an accident, they tend to think things are open-and-shut. If someone was drunk, what more is there to consider? Well, alcohol-related accidents can actually present significant hurdles for the victims and families involved. What people don’t always know is that there may be an alcohol provider responsible for contributing to the accident.
Alcohol providers in Texas who over-serve someone that is obviously intoxicated can potentially face criminal investigations, fines, suspended licenses, or liability for resulting injuries. Too often, though, they slip through the cracks. Since a lot of people, including authorities, tend to put all of their focus on drivers, a negligent alcohol provider might slip by unnoticed, allowing them to continue putting the community in danger.
So when I see accidents like this, I can’t help but think about all of the alcohol-related accident cases I’ve handled where authorities never bothered investigating the possibility of a negligent alcohol provider. At the end of the day, there are victims and families involved in the accident who deserve to know they’re going to get answers. It’s especially important they know that any wrongdoers involved in the accident are going to face appropriate consequences. Were those steps ever taken here?
