Commentary by Attorney Michael Grossman

If allegations here are true, and the crash involved an intoxicated driver, that would be relatively unusual considering the time of day at which the crash happened. More often, one would expect to see an intoxicated driver crash late at night or earlier in the morning. That said, it’s not unheard of. I’ve handled hundreds of cases involving drunk drivers, for example, and they happen at all times of day. Even just before 10:00 a.m., there are alcohol provider open and ready to serve people, sometimes unlawfully over-serving them. That’s why it’s important to make sure crashes like this get attention regardless of what time of day it is. There might just be an individual intoxicated driver who needs to be held accountable, but there could also be a local alcohol provider whose actions contributed to the crash, as well.
