Commentary by Attorney Michael Grossman

If the allegations here are true, there may be a lot more to this story than people realize. Early morning on a Sunday is the peak hour for drunk drivers hitting the roads because people go out drinking Saturday into the overnight hours. It’s important, then to find out if the alleged drunk driver here was over-served by a local establishment. That alcohol provider might also be responsible for contributing to this accident.

Simply put, an alcohol provider who unlawfully over-serves alcohol to an obviously intoxicated person can face criminal investigations, fines, suspended licenses, and liability for the injuries the intoxication causes. Just as drunk drivers are held accountable for their actions, negligent alcohol providers can also answer for theirs.

But if authorities are too narrow in their scope, they might end up letting a negligent alcohol provider off the hook. Having worked with hundreds of families affected by drunk drivers, that’s not an acceptable outcome. At the end of the day, victims and families deserve to know that all parties who wronged them will face the appropriate consequences.
