Commentary by Attorney Michael Grossman
When someone is seriously hurt in a late-night crash and the driver is accused of being intoxicated, it’s natural to focus on what happened behind the wheel. But it’s just as important to ask: How did the driver end up impaired in the first place?
That question often gets overlooked in police investigations. Yet in cases like this, where someone faces charges of intoxication assault, it’s worth asking whether a bar or restaurant played a role by serving someone who was already obviously intoxicated. Under Texas dram shop laws, alcohol providers are required to stop service when a person shows clear signs of intoxication, and if they ignore that obligation, they can be held accountable for the harm that follows.
Getting the whole truth means going beyond what happened on the road and looking at where the alcohol came from. If an alcohol provider contributed to this crash by overserving the driver, identifying them is a key step toward accountability, and a necessary one if we want to reduce the risk of more crashes like this in the future.
