Commentary by Attorney Michael Grossman

Folks tend to think alcohol-related accidents are open-and-shut just because it seems obvious who’s to blame. It may be obvious that a drunk driver is doing something wrong, but not everyone knows how often there’s an accomplice to these situations: a negligent alcohol provider.

Simply put, alcohol providers who unlawfully over-serve someone that is obviously intoxicated can be exposed to potential criminal investigations, fines, license suspensions, and liability for resulting injuries. This can help to ensure both that they can be held accountable for their mistakes, and it can help clean up a negligent alcohol provider’s act so they don’t go out and cause more harm.

Unfortunately, this isn’t always a high priority for the police. I’ve handled hundreds of cases against negligent alcohol providers, and there were few cases where authorities took steps independently to see those alcohol providers held accountable after a serious accident. It’s possible authorities here have been more thorough in their efforts, but that’s going to require more thorough investigations to say for sure.
