Commentary by Attorney Michael Grossman
When reviewing crashes like this, it’s important to ask not just what happened, but why it happened. Authorities now allege that the driver of the Audi was intoxicated, which raises serious concerns about how he ended up behind the wheel in that condition.
One critical question in any drunk driving case is where the driver obtained alcohol. Texas law prohibits bars, restaurants, and other establishments from serving alcohol to someone who is obviously intoxicated. If an alcohol provider continued serving the driver despite clear signs of impairment, that business could share responsibility for the crash under Texas dram shop law.
Dram shop laws exist to hold alcohol providers accountable when their reckless service contributes to preventable crashes. They not only give injured victims a path to seek justice but also reinforce the importance of responsible alcohol service. When establishments follow the law, they help reduce the number of impaired drivers on the road and protect the public from harm.
For those injured in this crash, getting the full truth is essential. If an alcohol provider played a role in this incident by unlawfully overserving the driver, they should be held accountable along with the driver himself. Identifying every party responsible isn’t just about assigning blame—it’s about ensuring that those who violate the law face consequences for their actions. Without accountability, these preventable crashes will continue to happen, and those harmed may never get the answers they deserve.
