Commentary by Attorney Michael Grossman

Something to consider after any motorcycle wreck is how thorough authorities are being in their investigations. It would surprise folks how often authorities jump to conclusions because they’re biased and think motorcyclists are inherently dangerous drivers. This can cause them to overlook important information to the contrary.

For example, I handled a case where a family wanted a second opinion about authorities blaming a crash on their loved one. The reports said a man was weaving through traffic and speeding on a motorcycle when he crashed into a truck. As we dug into things, we found the officer had really only based the reports on a single witness’s statements. When we showed the reports to that witness, they were as shocked as the family.

Apparently, the witness never said the motorcyclist was speeding or weaving. What they said was that the victim passed them on the left—a perfectly normal, reasonable maneuver. The investigating officer was inexperienced, though, and completely misinterpreted this to mean the victim was being reckless. Once we brought this and other crucial evidence to the attention of the authorities, they had no choice but to apologize for the mistake and correct the reports.

I’m not saying anything like that happened here, just to be clear. My point is that it’s best not to take for granted that authorities are going to give a serious crash like this extensive, thorough investigations. Otherwise, families can find themselves weeks or months down the line with the same doubts and unanswered questions. Hopefully steps have been taken here to avoid that.
