Commentary by Attorney Michael Grossman
When I hear about a crash like the one that occurred during the morning hours of May 10th on Interstate 15—where a vehicle rolled over and left one person critically injured—it highlights just how much remains unknown after the initial report. A rollover crash often triggers assumptions about speed or inattention, but those early conclusions can be misleading. From my perspective, there are three key questions that must be asked if we want to truly understand what happened and ensure those involved get the answers they deserve.
The first question is whether the authorities have conducted a thorough investigation. Rollover crashes are complex and can result from any number of contributing factors—some of which may not be immediately obvious. Investigators should be examining physical evidence at the scene, looking at the vehicle’s path off the roadway, and collecting any witness accounts. Yet, how thoroughly that happens often depends on the training and resources of the agency handling the investigation. In many jurisdictions, especially those covering large areas like interstate highways, departments are often stretched thin, which can impact how detailed an investigation ends up being.
The second question is whether the possibility of a vehicle defect has been considered. Rollover incidents raise immediate concerns about stability, suspension integrity, and tire condition, among other things. If something as seemingly minor as a tire failure occurred, it could have set off a chain reaction resulting in the vehicle losing control. Even seatbelt function can come into play if injuries are more severe than expected. These types of failures are not always easy to detect, and unless someone is specifically looking into the mechanical systems involved, they may never come to light.
The third question is whether all available electronic data has been collected. Most vehicles today are equipped with event data recorders that can capture critical moments before a crash—like speed, brake use, and steering input. That data can be crucial in distinguishing between driver behavior and mechanical malfunction. Additionally, any GPS logs or cell phone data might offer insight into what was happening in the vehicle moments before the crash. If investigators fail to collect this information early, it can be difficult, if not impossible, to recover later.
At the end of the day, a serious crash like this isn’t just a matter of what happened—it’s a matter of why it happened. And the answers to that question depend entirely on how well the investigation addresses these
