Commentary by Attorney Michael Grossman

To be rather blunt, wrong-way accidents always raise red flags of potential intoxicated driving. While I wouldn’t suggest ignoring that, it’s important to consider all possible factors, regardless of how unusual they seem.

For example, here in DFW, there was a tollway that was seeing an unusually high number of wrong-way drivers. A research team was able to determine that the warning signs on exit ramps were too high up. The signs were lowered, and, lo and behold, the number of wrong-way drivers went down.

Is it more likely for something like this to be the result of a driver who was unlawfully over-served by a bar? Of course. My point is that it’s best to avoid jumping to conclusions until all the facts are clear.
