Commentary by Attorney Michael Grossman
Single-vehicle accidents can already present some unique challenges, but a commercial vehicle only increases that challenge. On top of possibilities like road conditions and vehicle defects, investigators also have to consider hours behind the wheel, cargo shifts, vehicle maintenance, training, pressure from employers to meet unreasonable deadlines, etc.
Truck drivers have a lot more challenges to overcome than the typical driver, and that needs to be reflected in the investigations. Otherwise, the conclusions may not fairly tell the driver’s side of the story. Hopefully authorities here have been able to dedicate the time and equipment needed for such a potentially complex crash. However, experience tells me a crash of this magnitude generally needs input from independent professional accident reconstructionists.
