Accident Report
August 23, 2026, Jose Varela Jr. was injured following an alleged drunk driver accident at around 2:20 a.m. along W. 5th Street.
Preliminary information about the accident says that the crash happened at the intersection of W. 5th Street (US 70) and Quincy.
According to officials, 44-year-old Jose Varela Jr. was riding a Harley-Davidson motorcycle westbound on W. 5th. At the intersection, a Ford F-150 collided with the motorcycle, seriously injuring Jose Varela.
Authorities say that the Ford driver was under the influence of alcohol and failed to stop and render aid. It appears they’ve identified that driver and are recommending charges. Additional details are unavailable.
How Did This Accident Occur?
If the allegations here are true, then it seems authorities believe that a drunk driver caused all of this. Recommending charges suggests that person will answer for their actions. But is that really all there is to the story? Maybe not. I’ve handled hundreds of investigations into drunk driving accidents where there were also negligent alcohol providers who needed to be held accountable, as well. Let me explain.
In Texas, it’s unlawful for bars, restaurants, clubs, liquor stores, and other establishments to serve someone who is obviously intoxicated. If they do so, and that leads to people getting hurt, the alcohol provider can be responsible for their role in the accident. 2:20 a.m. on a Sunday is just about the most likely time for something like this to happen. People go out drinking on a Saturday, bars serve them all the way up till closing time, then send them on their way at dangerously high levels of intoxication.
So, did something like that happen here? Maybe authorities have already figured that out behind the scenes. But if they just charged the alleged drunk driver and moved on, that unfortunately wouldn’t be unusual. I can’t count how many times families came to us with similar crashes where authorities never bothered looking for any accomplices to the accident. When that happens, it’s important for independent investigators to move quickly while evidence is still intact. That way, the victims and families can rest assured that all wrongdoers who broke the law and contributed to their hardships will answer for their actions.
Does anyone think there may have been a negligent alcohol provider involved in this accident? Tell me why or why not in the comments.
