How Did This Accident Occur?
I don’t know anything more about this specific accident, and I’m not here to speculate. In general, though, pedestrian accidents can be a lot more challenging than folks may realize. A lot of the time when I get calls from people about pedestrian accidents, they just assume it’s all about if the victim was in a crosswalk. That’s not really how things work, though. Accident reconstructionists will generally focus on whether or not the victim was clearly visible and reasonably avoidable.
For example, let’s consider a hypothetical where a pedestrian is crossing in an area where they don’t have the right-of-way. If a driver can see the pedestrian, and they’re far away enough to slow down or go around the person, does the driver get to run them over just because they have the right-of-way? Obviously not, that would be ridiculous. The law accounts for that. On the other hand, if the driver couldn’t have seen and avoided the pedestrian in time despite driving safely, it would be just as ridiculous for them to be responsible for something they couldn’t avoid.
Hopefully authorities are taking this accident seriously and preserving evidence that accident reconstructionists can use to put all the pieces together. By understanding where the victim was, how visible they were, and what the driver was doing in the moments leading up to the crash, investigations should be able to give the victim’s loved ones a clear picture of what happened, one way or the other. However, it wouldn’t be the first time authorities left unanswered questions behind for independent investigators to step in and clear up.
