Midland, TX — June 7, 2024, Steven Wimberly was killed as the result of a work accident at 8:00 a.m. along County Road 1198.

OSHA officials said that the accident happened off County Road 1198 and County Road 120 south of Midland.

In their initial investigation summary, officials said that 48-year-old Steven Wimberly was by a trailer where other workers were unloading equipment. As they did so, the equipment somehow fell, landing on Steven Wimberly.

Steven Wimberly died as a result of the accident. No other injuries were reported. The OSHA inspection listed three alleged violations and a recommended penalty.

People often see that OSHA looked into a work accident and figure authorities will take care of everything. However, OSHA’s efforts typically just scratch the surface. Texas has particularly complex work fatality accident laws—the most complex in the whole country—which require thorough investigations and a lot of legal experience to efficiently navigate. It would be good to hear if those steps were taken here, but it might surprise folks how often a fatal work accident just slips through the cracks without the attention it deserves.
