Commentary by Attorney Michael Grossman

It often surprises people when they wait around for OSHA to get answers about an accident only to end up with something that looks a lot like what I’m seeing here—which is to say, not a whole lot. Ultimately, OSHA has their own priorities. Getting answers for the public—and even for the worker’s family—is not necessarily one of those priorities.

As such, a lot of workers’ loved ones find they need to have independent investigators step up and fill in the blanks. Sometimes, those efforts prove some closure. Other times, they reveal a path to seeing accountability for a worker’s avoidable death.

What those efforts might yield here isn’t for me to say based solely off these sparse reports. However, I can’t recall a single example across my nearly 40 years of handling fatal work accident cases that didn’t benefit from having multiple sets of eyes look things over.
