Commentary by Attorney Michael Grossman
If it’s true that this accident involved a drunk driver, things may seem rather open-and-shut. But alcohol can present an additional dimension to an accident investigation. In order to truly be thorough, investigations have to find out where that alcohol came from. Here’s why.
In Texas, alcohol providers can be responsible for contributing to an accident caused by a driver whom they over-served. If a bar, restaurant, or similar establishment serves someone who is obviously intoxicated, then they can be held accountable if that intoxication leads to people getting hurt or killed.
Too often, the investigations begin and end at the crash scene. That may lead to an alleged drunk driver answering for their actions, but a negligent alcohol provider is bound to continue putting lives at risk until they, too, answer for their actions. That’s why, in my experience, it’s best steps are taken to make sure someone is investigating beyond the accident seen so that all parties who played a role in the crash face appropriate consequences.
