Dallas, TX — January 12, 2024, Jose Estrada Luna was killed as the result of a work accident at around 8:55 a.m. along Lake June Road.

Investigations from the Occupational Safety and Health Administration say the accident happened off Lake June Road and Pemberton Hill Road, just west of US 175.

The OSHA accident investigation summary says that 58-year-old Jose Estrada Luna was by a trench as an excavator was picking up a trench box. The ground apparently gave way under the excavator, causing the trench box to fall on Jose Estrada Luna.

Due to the accident, Jose Estrada Luna was killed. The OSHA summary lists one alleged “serious” citation. Right now, additional details are unavailable.

There might be a tendency for some people to see this as some freak occurrence. However, OSHA alleging there was a violation here raises serious red flags. The question is if anything was done beyond a mere citation.

Families often learn the hard way that OSHA isn’t really hear to get them the help they need after a loved one is killed on the job. OSHA has their own priorities, and that leaves families to navigate the most complex work fatality laws in the country.

That legal maze can be successfully navigated, but it takes a lot of preparation, investigation, and strategy. Simply relying on OSHA to handle things on their own isn’t going to be enough.
