Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that I hope the injured pedestrian and his family receive the answers they deserve. A late-night collision between a vehicle and a pedestrian is always serious, and while the initial report gives a basic outline, it leaves out key facts that could make a difference in understanding what truly happened. It’s common to assume that pedestrians are at fault when they’re struck at night, but in my experience, these cases are rarely so simple. To properly evaluate what happened on State Highway 199, there are three important questions that must be asked.

First, did the authorities thoroughly investigate the crash? A full and fair investigation involves more than just documenting the location and vehicle information. Did officers assess the lighting conditions in the area at the time of the crash? Were there any signs of crosswalks or pedestrian right-of-way? Was there any physical evidence — like skid marks or vehicle debris — documented at the scene? It’s also important to determine whether any surveillance footage or witness statements were collected. These steps can help clarify whether the pedestrian was visible and whether the driver had a chance to avoid the collision.

Second, has anyone looked into whether a vehicle defect may have played a role in the crash? The 2009 Ford Ranger involved in this incident is an older vehicle, and mechanical issues such as faulty headlights, brake failure or steering problems could affect a driver’s ability to avoid a pedestrian, especially at night. A proper investigation should include a forensic inspection of the vehicle to rule out any such defects. Unfortunately, vehicle defects are often overlooked unless someone actively takes steps to preserve the vehicle and examine it properly.

Finally, has all the electronic data related to the crash been collected? The Ford Ranger’s engine control module may store key data such as speed, throttle position and braking input before the impact. That kind of information can help confirm whether the driver made any effort to stop or swerve. In addition, nearby traffic or business surveillance cameras could provide critical visual evidence. If the pedestrian had a phone or wearable device, GPS data might also help establish where he was walking and how long he had been in the roadway. This type of evidence can be lost quickly if it’s not secured right away.

A crash like this deserves more than just a line in a report. A man was seriously injured, and the only way to determine what really happened is to ensure all the evidence is collected and all the right questions are asked. Only by doing that can we provide the clarity and accountability that those affected deserve.
