Commentary by Attorney Michael Grossman

When an SUV is hit by a semi-truck, most people assume the truck driver must have done something wrong. That may turn out to be true, but it’s just as likely that other factors played a role. The key to determining fault in a crash like this isn’t making assumptions: it’s gathering hard evidence.

The first step in any proper investigation should be to secure the truck’s electronic data. Most modern trucks have an engine control module (ECM), sometimes called a “black box,” which records speed, braking and other critical details leading up to the crash. Was the truck driver speeding? Did they brake in time? That data could answer those questions.

Investigators also need to consider visibility and road conditions. Interstate 12 is heavily trafficked, and nighttime driving always carries extra risks. Did poor lighting or road design play a role? Was the SUV disabled on the road before impact, and if so, did the driver have their hazard lights on? Without gathering those details, there’s no way to get a full picture of what really happened.

Too often, investigations stop at the crash scene and rely on surface-level conclusions. But real accountability requires looking deeper, into driver behavior, vehicle condition and the decisions made leading up to the wreck. Anything less than that leaves important questions unanswered.
