Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope investigators are doing everything possible to uncover what happened. Hit-and-run accidents present unique challenges, but that doesn’t mean those affected should be left without answers. Any thorough investigation should address three critical questions.
First, did the authorities conduct a thorough investigation? The report states that the pedestrian was crossing the highway when he was struck, but it doesn’t explain why the driver didn’t stop or whether other factors contributed to the crash. A complete investigation should involve accident reconstruction, an analysis of roadway lighting and a review of any available witness statements. Was the area well-lit, or were visibility issues a factor? Were there any traffic signals or crosswalks nearby that might have influenced how the pedestrian crossed? These are essential questions to ensure a full understanding of the circumstances.
Second, has anyone considered whether a vehicle defect played a role? In hit-and-run cases, people often assume the driver fled due to panic or fear of legal consequences, but mechanical failures can sometimes be a factor. Did the Honda CRV have braking issues, steering malfunctions or faulty headlights that contributed to the crash? If the vehicle was abandoned, securing it for a forensic examination could help determine if a mechanical issue played any role. Without that analysis, key details may go overlooked.
Lastly, has all the electronic data from the crash been preserved? A Honda CRV is equipped with an engine control module that records data such as speed, braking activity and steering input. This information could help clarify whether the driver attempted to stop or swerve before impact. Additionally, surveillance cameras from businesses near where the vehicle was abandoned could help identify the driver, and cell phone records may provide further clues. However, this kind of evidence is time-sensitive, and if it isn’t collected quickly, it may be lost.
At the end of the day, hit-and-run crashes leave more questions than answers, and those affected deserve to know the truth. Ensuring a thorough investigation, exploring all possible causes and preserving all available evidence are critical steps in that process. When a life is lost in a crash like this, the least the community can do is make sure every effort is made to find out exactly what happened.
