San Antonio, TX — November 20, 2024, Erandica Alarcon was injured following an alleged drunk driver accident at around 9:35 p.m. along Loop 410.

According to initial details released by authorities, the incident took place along southbound lanes of the interstate near Ingram Road.

Investigators said that 56-year-old Erandica Alarcon was a passenger in a Chevy Traverse going southbound along Loop 410. While doing so, a Chevy Trax left its lane, and the vehicles collided. Due to the collision, Alarcon was seriously injured. There did not appear to be any other injuries.

Authorities allege that the Trax driver was under the influence of alcohol at the time. They recommended charges for DWI.

Since drunk driving is obviously wrong, and since authorities here recommended charges, people may be quick to assume this is all open-and-shut. A lot of alcohol-related accidents, though, end up presenting significant challenges. This is because many of them involve drunk drivers who were unlawfully over-served by an alcohol provider, and that’s not something authorities tend to look into.

Put simply, bars and other providers who serve people that are obviously intoxicated can potentially face criminal investigations, fines, or liability for the injuries resulting from that intoxication. I’ve handled hundreds of cases against negligent alcohol providers, and authorities aren’t often conducting their own investigations. I’ve even had cases where we handed over evidence to the authorities on a silver platter, and officials still dropped the ball.

It’s possible authorities here have been more thorough and are ensuring all parties responsible for this accident face appropriate consequences. But if that required more thorough independent investigations, it certainly wouldn’t be the first time.
